Camila de Gamboa Tapias, Associate Professor at Universidad del Rosario in Colombia is the author of the recently published CAPAZ Policy Brief.
This is the second CAPAZ blue series (línea azul) publication, as part of the project entitled: “Stabilisation of peace through justice and truth”, coordinated by CAPAZ and the Centre for the Study of Latin American Criminal Law and Criminal Procedure (CEDPAL) at the University of Göttingen, Germany.
Restorative justice is a dimension of justice that originates from more traditional and ancestral conceptions of how to deal with the harm caused to victims by offenders in a community. In this approach, the needs of the victims created by the damage; the recognition of the responsibility of those who commit the offences, their rehabilitation, and the participation of the community are essential.
This document entitled “The Role of Restorative Justice in the Colombian Comprehensive System of Truth, Justice, Reparation and Non-Repetition” analyses the role of restorative justice in this system included in point 5 of the Havana Final Agreement, “Agreement on the Victims of the Conflict”. In order to conduct this analysis, the author first presents certain features of restorative justice and refers to its relationship with transitional justice. Secondly, the paper shows how the SIVJRNR adapted some of the characteristics of restorative justice in terms of transitional justice. Finally, a number of recommendations are made, based on this analysis, to contribute to the discussion.

Blue series publications are part of the CAPAZ and CEDPAL projects: “Stabilisation of peace through justice and truth”, intended to help strengthen the Comprehensive System of Truth, Justice, Reparation and Non-Repetition (SIVJRNR) within the framework of the peace process in Colombia. The project involves CAPAZ, CEDPAL, the Special Jurisdiction for Peace (JEP), and the Commission for the Clarification of the Truth. The blue line documents are intended to enable the circulation of knowledge on issues that are crucial to the development of the mandate of the institutions that comprise the SIVJRNR, among the non-legal or non-expert public in transitional justice.
